Williams Teusink Successfully Defends Murray County to Stop Proposed Anaerobic Digester Facility

In a highly contested and controversial land-use and zoning appeal, R. Kyle Williams recently successfully represented Murray County, Georgia, and its Sole Commissioner, Noah Bishop, to defend the revocation of zoning approvals, effectively stopping a proposed anaerobic digester facility in Chatsworth, Georgia.

As Special Counsel to the County, Williams argued to the Murray County Board of Appeals and before a hearing room packed with concerned citizens that Commissioner Bishop was authorized as the governing authority for the County to revoke zoning approvals after new information came to light that the proposed facility would be an industrial use and not compatible with the location’s agricultural zoning.

At the conclusion of the hearing, the Board of Appeals voted unanimously to uphold Commissioner Bishop’s decision to revoke prior zoning approvals issued for the proposed facility.

“The unanimous decision by the Board of Appeals is not only a win for Murray County and its citizens, but it affirms longstanding Georgia law that a land-use and zoning decision made in error is void from the beginning and affords no vested rights,” Williams said. “The law here did not change. The known and disclosed facts here changed. Commissioner Bishop had no choice but to revoke the previous zoning approvals when it became known that the proposed facility was industrial and not agricultural.”
